US District Court Issues Permanent Injunction Against Unauthorized Reseller of Standard Process Products
PALMYRA, Wisconsin (December 19, 2008) – A permanent injunction issued by the United States District Court Eastern District of Wisconsin prevents Total Health Discount Inc. from representing themselves as an authorized seller of products made by Standard Process Inc.®. Standard Process is a Wisconsin-based manufacturer of nutritional whole food supplements.
The injunction in the Standard Process Inc. v. Total Health Discount Inc. case requires Total Health to prominently display a disclaimer on its websites indicating that it is not affiliated with Standard Process and is not an authorized seller of the company's products. Among other court-ruled prohibitions, Total Health may no longer use product pictures or Standard Process logos on the website, solicitations or advertisements.
"Standard Process is pleased with the outcome of the trial and will continue to enforce our resale policy against violators, as well as those who infringe on the company's copyrights and trademarks," said Scott Vandenhouten, general counsel, Standard Process.
The Standard Process resale policy is based on the company's long-held philosophy that proper use of its nutritional whole food supplements is best accomplished through informed guidance by a health care professional. Individuals and organizations not complying with the company's resale policy are subject to account termination.
